  • Affirmative Action – A system of specific steps that seek to ensure that certain groups of people who have been historically discriminated against are provided equal opportunity to participate in 就业 and accompanying benefits, without lessening educational or 就业 requirements, in compliance with federal law and regulation as applied to federal contractors.  A central premise underlying affirmative action is that, 随着时间的推移, absent discrimination, a contractor’s workforce will generally reflect the gender, 种族, and ethnic profile of the labor pools from which the contractor recruits and selects.
  • 歧视, Different or unequal treatment of an individual (or group), based on one or more of the protected classes (see definition below) of the individual (or group), except as where permitted or required by law, that negatively affects their education, 就业, or other participation in educational programs or activities.
  • 平等的机会 - 就业 or educational practices that seek to ensure non-discrimination on the basis of protected classes (see definition below).
  • 骚扰, A form of discrimination; unwelcome oral, 写, 图形, or physical conduct, based on one or more of the protected classes (see definition below) of an individual (or group), that is sufficiently severe, 持续的, or pervasive so as to unreasonably interfere with their education, 就业, or other participation in educational programs or activities or that creates a working, 学习, or educational program or activity environment that a reasonable person would find hostile, 令人生畏的, 或虐待.  Harassment may include, but is not limited to, 威胁, physical contact or violence, 进攻的笑话, insults or put-downs, slurs or name calling, vandalism/graffiti, or offensive objects or pictures.  琐碎的怠慢, 烦恼, and isolated incidents (unless very serious) typically do not rise to the level of 骚扰.
  • Protected Activity – Activity which may include, but is not limited to, filing a discrimination and/or 骚扰 complaint, reporting discrimination and/or 骚扰, or participating in a discrimination and/or 骚扰 investigation.
  • Protected Classes – For NDSU’s purposes, protected classes are those related to: age, color, gender expression/identity, genetic information, 婚姻状况, 国家的起源, physical or mental disability, 怀孕, public assistance status, 比赛, 宗教, 性, 性ual orientation, spousal relationship to current employee, 在美国的地位.S. 经验丰富的, or participation in lawful activity off NDSU’s premises during nonworking hours which is not in direct conflict with the essential business-related interests of NDSU (See NDSU Section 100, Equal Opportunity and Non-Discrimination Policy, for more information).
  • 报复- - - - - - 恐吓, 骚扰, 报复, or other adverse/unfavorable action taken against an individual (or group) in response to their protected activity, which could include, but is not limited to, filing a discrimination and/or 骚扰 complaint, reporting discrimination and/or 骚扰, or participating in a discrimination and/or 骚扰 investigation.
  • Sexual Misconduct – A broad term encompassing all forms of gender-based 骚扰 or discrimination and unwelcome behavior of a 性ual nature. The term includes 性ual 骚扰, gender-based 骚扰, nonconsensual 性ual contact, nonconsensual 性ual intercourse, 性侵犯, 性ual exploitation, 跟踪, 公然猥亵罪, intimate partner violence, 性暴力, and other misconduct based on 性. 
     
  • 第九条 - Federal law that prohibits discrimination on the basis of 性 in education programs and activities that receive federal financial assistance.
